"Because the drill was required training for an actual emergency, Kedroski was reasonable to believe that he was faced with an emergency," the lawsuit says. It also says that the city has refused to pay the insurance premiums after City Manager Jason Bajor was asked to do so. Kedroski is asking the city to pay for his insurance premiums, reimburse him for insurance costs he has incurred since the time of the injury and pay reasonable attorneys fees and costs, said John Q. Kelly, a New York catastrophic injury lawyer.
City Attorney Dave Wiltse Monday did not comment on the lawsuit when contacted Monday saying the city has not yet been served.
